Fermin Duran Jr., 29, was killed in a Modesto car accident after his bicycle was struck by a car the night of February 4, 2010, the Modesto Bee reports. California Highway Patrol officials say Duran was stopped and on his bicycle, in the eastbound lane of West Service Road, when he was struck by a speeding GMC Suburban. The SUV, driven by 22-year-old Pedro Avalos, was unable to stop in time to avoid the collision. Avalos was not cited at the scene, but CHP officials say charges may be forthcoming.

Bicycle Accident Statistics
There were two fatalities and 69 injuries involving bicycle accidents in Modesto in 2007, according to CHP's Statewide Integrated Traffic Records System (SWITRS). In Stanislaus County as a whole, nine deaths and 160 injuries were reported as a result of bicycle accidents during the same year.
Speed Laws
Based on this news report, CHP officials say drugs or alcohol was not a factor in this fatal bicycle versus car accident. However, officials are saying that the maximum speed allowed on that roadway is 55 mph "under optimal conditions." On Thursday when the accident occurred, it was raining and the roadway was wet. The driver may be cited for going too fast given the dark and rainy conditions. CHP officials are saying that it is incumbent on drivers to operate at a speed that if they encounter something stationary on the roadway, they are able to maneuver and avoid it, especially in country roads.
California Vehicle Code Section 22350 (Basic Speed Law) states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property."

Patrick Rogers, 41, was killed in a San Jose car accident after his motorcycle struck a car that was stopped to make a right turn. According to a news report in the San Jose Mercury News, Rogers was westbound on Cherry Avenue at Geomax Court, in his 1999 Harley-Davidson, the night of January 30, 2010. At the time a 2005 Cadillac Escalade driven by 51-year-old Christopher Caprino was stopped on Cherry to turn right into an apartment complex. Rogers struck the Cadillac. One person was injured in a Bakersfield car accident after officials say a school bus driver ran a red light and crashed into a pickup truck. According to an ABC 23 news report, the bus was going south on Monitor Street at Pacheco Road the afternoon of February 2, 2010, when the school bus driver ran the red light at the intersection and struck the pickup truck. One girl from the bus was transported to a local hospital. She apparently hit her head against the window. Another student on the bus was uninjured. The school bus driver sustained arm injuries. Elsie "Alice" Stefani, 82, was killed in a San Francisco car accident after she was struck by a vehicle while crossing the street in a marked crosswalk the evening of January 28, 2010. According to a Bay City News report, Stefani was walking east in the north crosswalk of Main Street and Fulton Road in Saint Helena, when 52-year-old Therene Pierrette, who was turning north from Madrona Drive, failed to yield right-of-way to the pedestrian and struck Stefani from behind. Stefani was caught underneath the vehicle and suffered critical injuries. She was transported to an area hospital and died shortly after the collision. Three pedestrians were injured in a San Diego car accident involving a suspected drunk driver, early morning on January 29, 2010. According to a 10news report, a driver, who officials believe was under the influence, hit three people standing outside a bar in Pacific Beach. The driver fled the scene of the crash but was arrested soon afterward at his home. San Diego police said one of the pedestrians sustained a broken leg and the other two sustained scrapes and bruises. Police were able to track the hit-and-run suspect with the help of witnesses. Grace Snyder, 17, was injured in an Oregon car accident after she was struck by a vehicle while crossing an on ramp at the Garden Valley Interchange in Roseburg. According to a KPIC news report, the driver, 38-year-old Laroy Cobb, fled the scene of the accident that happened the evening of January 23, 2010. But officials were able to get a description of Cobb's vehicle out and the suspect was eventually stopped and arrested by Oregon State Patrol officials. Cobb is facing a number of criminal charges including failure to perform the duties of a driver, assault, reckless endangerment and failure to stop and remain stopped for a pedestrian. Three children in Salinas, California, were hurt in a school bus accident after a GMC Yukon SUV backing out of a driveway struck the bus. According to a news report in the Monterey Herald, the bus was making a turn onto East Bernal Drive from Rosarita Drive the afternoon of January 26, 2010, when it was hit by the SUV. California Highway Patrol officials said three children were found to have sustained neck injuries. The other children, the driver of the SUV and the bus driver were uninjured. A woman was fatally injured in a Long Beach car accident early morning on January 27, 2010 after her car crashed into a security gate at the end of the Terminal Island (103) Freeway. According to a news report in The Press Telegram, the woman was driving a 1999 Chrysler Sebring north on the freeway when she failed to slow down at the Willow Street intersection and slammed into a closed security gate. The car became airborne and then crashed into a building. The woman was ejected from the vehicle and suffered major internal injuries. She died at the scene.
