A 5-year-old boy has been hospitalized with injuries after a San Jose car accident, which officials say, was caused by a hit-and-run driver the afternoon of January 20, 2010. According to a CBS news report, the boy was standing in front of his home's garage when he was struck by a Honda Accord. A police officer had noticed the driver of the Honda Accord driving erratically but was unable to prevent the crash. The Honda struck another car causing minor injuries to its occupants and then hit the boy and the garage, before causing a break in a gas line. Police are still looking for the hit-and-run driver who ran away from the scene.

My heart goes out to the injured 5-year-old boy and his family. I sincerely hope his injuries were not serious and wish him a speedy and complete recovery. He will certainly be in my prayers.

What Caused this Accident?

Based on this news report, it appears that the driver of the Honda Accord was driving erratically. It is important in these types of injury accidents, to determine what caused the motorist to drive erratically. Was he under the influence of alcohol or drugs? Was he distracted by something? Was he racing another vehicle? Was he simply being reckless at the time? I trust this driver will soon be apprehended and brought to justice for the injuries and damages he caused. Apart from the injuries, 50 neighbors also had to be evacuated until the gas line rupture could be fixed. This hit-and-run driver should be held criminally and civilly liable for this injury accident.

Hit-and-Run Laws

Leaving the scene of the accident is also a serious crime under California law. According to California Vehicle Code section 20001: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."
