A woman sustained serious injuries in a Los Angeles car accident after being trapped in the wreckage on June 27, 2010, CBS News reports. Los Angeles Fire Department officials say that the two-vehicle crash occurred on Arminta Street near Sunland Boulevard in Sun Valley. One more person was also injured, but the extent of his or her injuries is not known. An investigation is ongoing.
My heart goes out to the injured victims of this car accident. I wish them both the very best for a quick and full recovery. They will be in my thoughts and prayers.
Los Angeles Car Accidents
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were 268 deaths and 25,588 injuries involving car accidents in Los Angeles. Countywide, 667 deaths and 52,229 injuries were reported as a result of car accidents during the same year.
Possible Accident Causes
This news report does not clearly state the circumstances of this injury crash. There are more questions here than answers. Which one of the drivers was at fault? Did the accident occur at the intersection? If so, did one of the drivers run a red light? Did one of the drivers fail to yield right-of-way? Was either one of the drivers intoxicated, distracted, reckless or negligent at the time of the collision? I trust officials are looking at these and other issues in order to determine what occurred here and why.
Failing to yield right-of-way is a serious traffic violation under California law. According to California Vehicle Code section 21800 (a): "The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway."
Fault and Liability
The driver who is determined to have been at fault in this case, could be held liable for the injuries, damages and losses caused to the other party. Injured victims could seek compensation to cover medical expenses, loss of wages, cost of hospitalization, surgeries, pain and suffering, and even long-term care.
Injured victims should refrain from talking to insurance adjusters or attorneys for another party. They should first seek the counsel of an experienced Los Angeles personal injury lawyer, who will stay abreast of the official investigation and ensure that the victims' legal rights and best interests are protected. Please do not sign any papers or agreements until you have talked to your attorney to determine the best course of action in your case.
