A motorcyclist and his passenger sustained serious injuries in a San Diego car accident the morning of February 14, 2010. According to a news report in The San Diego Union-Tribune, the major injury collision occurred at the intersection of Carlsbad Boulevard and Christiansen Way. Police said a car driven by a 16-year-old girl struck the motorcycle. Both the motorcyclist and his female passenger were transported to area hospitals with serious injuries. The teen and her passenger were uninjured. No one has been cited or arrested pending an ongoing investigation.
I sympathize with the two injured victims of this crash. I hope and pray that they did not sustain any catastrophic injuries. I wish them the very best for a speedy and complete recovery. Please keep them in your prayers.
Motorcycle Accident Statistics
There were no fatalities, but 49 injuries involving motorcycle accidents in Carlsbad in 2008, according to California Highway Patrol's traffic accident statistics. Also, in 2008, in San Diego County as a whole, motorcycle accidents claimed 51 lives and injured 1,081 people. Countywide, there were reports of 246 fatalities and 13,527 injuries as a result of car accidents during the same year.
Causes and Liability Issues
Based on this news report, there are more questions than answers here. Where was the motorcycle on the roadway at the time of the accident? Was the teen driver making a turn at the time of the collision? Why did she fail to see the motorcyclist? Was the teen speeding, driving recklessly or negligent in any way? Hopefully, the answers to these questions will help determine who or what caused this accident.
In such cases, injured victims would be well-advised to contact an experienced San Diego personal injury lawyer who will stay on top of the official investigation and make sure that the victims' legal rights and best interests are protected. A skilled car accident lawyer will also be able to determine whether a dangerous condition on the roadway caused or contributed to the accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could be held liable. Any such claim against a California governmental agency must be properly filed within 180 days of the accident or injury.
