Six people were injured in a San Diego car accident that involved at least three vehicles. According to a news report in The San Diego Union-Tribune, the accident occurred in the Spring Valley area the morning of February 28, 2010. A BMW was going south on Avocado Boulevard when it struck a Honda whose driver was attempting to make a left turn on to Challenger Boulevard. The Honda spun around, the BMW went off the roadway, hit a wall and then a truck parked in the driveway of a home. Six people were transported to local hospitals for treatment of injuries. One woman sustained a head injury. An investigation is ongoing.

I hope the woman who was injured in this crash did not sustain any catastrophic injuries. I wish her and the other injured victims the very best for a speedy and complete recovery. Please keep them in your prayers.

San Diego Car Accidents

There were 81 fatalities and 6,123 injuries involving car accidents in San Diego in 2008, according to California Highway Patrol's traffic accident statistics. In San Diego County as a whole, 246 deaths and 13,527 injuries were reported as a result of car accidents in 2008.

The Law Relating to Left Turns

Based on the news report, this injury collision occurred right at an intersection when one of the vehicles was attempting to make a left turn. California Vehicle Code Section 21801 (a) states: "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."

Fault and Liability

In such cases, the focus of the investigation is on who had the right-of-way at the intersection. In this particular case, there are still a few questions concerning who had the right-of-way or the green light at the time. Did the vehicle turning left have a green arrow? Did one of the vehicles run a red light?

The injured victims in such cases, would be well-advised to consult an experienced San Diego personal injury lawyer, who will analyze all aspects of the case and make sure that their legal rights and best interests are protected. If there was a dangerous condition on this roadway, the city or governmental agency responsible for its maintenance could also be held liable. Please remember that any claim against a governmental entity must be properly filed within 180 days of the accident or injury, under California law.
