Nine people were injured in a San Francisco car accident the morning of January 5, 2010 after a San Francisco Municipal Railway bus collided with a small truck at a street intersection. According to a Bay City News report, the injury accident occurred near 18th and De Haro streets when a Polk-19 bus that was headed north on De Haro, crashed into the truck. The bus then went off the road. Seven of the injured victims, including the bus driver, were taken to the hospital with moderate injuries. The driver of the truck sustained serious injuries, San Francisco police said.
Seven Passengers Sustain Injuries
I truly hope all those who were injured in this bus accident recover quickly and completely. I also hope none of their injuries were serious. My best wishes go out to them especially, to the seriously injured truck driver for a speedy and complete recovery. Please keep these injured victims in your prayers.
Based on this news report, we don't know exactly what caused this injury accident. However, if the details of this news report are accurate, this accident occurred at a street intersection. So, there are a few questions that come up here. Did the bus driver or the truck driver fail to yield right-of-way at the intersection? Was one of the drivers distracted, impaired, speeding or otherwise driving recklessly?
Liability Issues in Bus Accidents
If the bus driver was distracted or at-fault for the accident, then he or she as well as the transit authority could be held liable for the injuries caused. In such cases, injured victims could seek compensation to cover medical expenses, loss of wages, cost of hospitalization, physical therapy and other related damages. A bus company is obligated to give their passengers a standard of "the utmost duty of care." This applies to companies both public and private. That essentially means that the bus company or transit authority is responsible for the safe transport of their passengers.
The injured victims in this case would be well-advised to consult an experienced San Francisco personal injury lawyer, who will analyze all aspects of this accident and make sure their rights are protected. Please remember that any claim against a governmental agency in California must be filed within 180 days of the accident or injury.
