Three workers were injured on the job after they fell from a three-story building that was under construction. According to a news report in The San Diego Union-Tribune, the construction accident occurred the morning of October 17, 2011 at the Euclid Family Health Center on Euclid Avenue, near Logan Avenue, in Valencia Park.

Officials say one of the men was holding a ladder at the top of the structure, while the other two were climbing up. For unknown reasons, the ladder failed and the two workers who were climbing up fell. The man on top of the metal structure was thrown to the ground. Two of the men suffered major injuries, while one sustained what were described as moderate injuries. All three workers, believed to be in their 40s, were transported to an area hospital for treatment. An investigation is ongoing.

My heart goes out to all three victims who have suffered injuries in this construction site accident. I wish them the very best for a speedy and complete recovery. Please keep them in your thoughts and prayers.

Statistics Relating to Falls

According to the Bureau of Labor Statistics, there were 847 fatal falls in 2007. Falls to a lower level, which accounted for 85 percent of all falls, were down 23 percent in 2008. However, it still remains a high number and proves to be the most serious hazard for workers, especially in the construction industry.

What Caused this Accident?

Based on this news report, it appears that the workers fell because the ladder failed. Was this accident the result of a defective product, specifically a defective ladder? Were the workers taking all necessary safety precautions at the time? Were they properly trained for the job that they were doing? Did they receive safety training? Were they provided with fall protection? The Department of Labor requires that fall protection be provided to workers at 4 feet in general industry, 5 feet in maritime, and at 6 feet in the construction industry. Regardless of distance, fall protection must be provided when working over dangerous equipment or machinery.

Workers' Compensation Issues

In such cases, injured victims can seek workers compensation benefits from their employers. However, they may also be able to file a third-party claim in cases where a party other than the employer is at fault. Examples of such third parties include general contractors, sub-contractors, property owners, and manufacturers of defective products. An experienced San Diego personal injury lawyer will better advise injured workers and their families about their legal rights and options.

There are a number of different damages that an injured auto defect victim can recover. Depending on your accident the damages that you can collect will vary. How much you receive for your damages can also change depending on your attorney. A skilled personal injury lawyer can help you to obtain the maximum recovery for your case.

As a victim it is a good idea to know what you can recover in an auto defect case. A few damages that most auto defect victims will recover are:

Past medical bills -- Any medical bill you have acquired from your accident can be recovered.

Future or ongoing medical treatment -- If you require future surgery you may recover money for that.

Loss Wages -- If you have missed work due to your injury you can recover damages for loss of wages. This applies to past lost wages and any loss of income in the future.

Pain and Suffering -- This could be due to your own injuries or the loss of a loved one. Whatever the pain and suffering is your entitled to recover money for that as well.

After an accident it is well advised for injured victims to seek help from a skilled California personal injury lawyer. The best personal injury lawyers will offer complimentary consultations. You will find that some law firms will also offer a no win no fee guarantee. This means that if they don't win your case you don't have to pay.

BISNAR | CHASE has been helping injured accident victims receive fair compensation for their injuries since 1978. We have helped thousands of injured victims recover hundreds of millions of dollars and would like to do the same for you.

The California Zicam lawyers at BISNAR | CHASE are hearing about more and more lawsuits and class-action lawsuits being filed over defective Zicam cold medications, which have apparently caused hundreds of people around the nation, to lose their sense of smell and/or taste. These recalled Zicam products, manufactured by Matrixx Initiatives Inc. were meant to relieve cold symptoms. But based on the reports we have gotten and, continue to get, these Zicam nasal cold remedy products have done more harm than good.

Man Loses Sense of Smell

According to a recent report on KITV, two more Hawaii residents have filed lawsuits claiming they have lost their sense of smell after using Zicam products. One of the plaintiffs, a 59-year-old man, says he took Zicam two years ago to get rid of a cold, but instead lost his sense of smell within a few weeks. The man says his quality of life has been destroyed and that he cannot smell or properly taste food now. Even a surgery could not fix the problem. In fact, some foods and smells make him uncomfortable, claustrophobic or even sick. For example, eating celery leaves a bad taste and even fresh strawberries taste overly ripe or rotten, for him.

Matrixx has known about its defective products for more than five years now. In fact, the company successfully defended Zicam lawsuits in 2004. Now, however, the pharmaceutical liability lawsuits are piling up, especially after the recall this last summer. The U.S. Food and Drug Administration is saying that at least 800 people have reported loss of smell after using Zicam cold medications. FDA warned consumers that the zinc in Zicam could cause irreversible damage to nerve in the nose.

Lack of Proper Testing and Research

These reports are examples of how Matrixx, and a lot of other pharmaceutical companies, put drugs on the market without properly researching or testing them. They're in a hurry to put these products out and start raking in the profits. Very often in these cases, corporate greed takes over as product manufacturers put profits over the people for whom these products are made. What's worse is that these defective products destroy lives. Zicam has taken away life's little pleasures for these victims, such as tasting food, wine or even smelling the flowers in the garden. It has been detrimental to the quality of life of hundreds, if not thousands, of Americans.

If you or someone you love has suffered from anosmia or a loss of sense of smell as a result of taking zinc-containing Zicam cold remedies, please call the pharmaceutical litigation attorneys at BISNAR | CHASE. We will schedule a free consultation to discuss and evaluate your particular drug injury case and will also put you on a list to be updated about the Zicam recall as we get more information. Any kind of pharmaceutical drug negligence is unacceptable and we will continue to fight for the rights of our clients – victims who have suffered irreversible damage and personal injury as a result of these defective Zicam products.

Our friends at the American Association for Justice (AAJ) recently released a report entitled "They Knew and Failed To," which gives numerous examples of defective products that remained in the market and caused serious personal injuries and even death to consumers. The report states that in all these cases, the product manufacturers knew that their products were dangerous and defective, but did nothing about it because they were more worried about their profits than the people who put their trust in those products and believed that they were safe.

Defective Products Injure and Kill Consumers

One of the defective products mentioned in AAJ's report is a Second Chance bullet proof vest that caused police officer Tony Zeppetella's death when he was shot in 2003. Second Chance apparently knew as early as 1998 that heat and sunlight caused the vest's material to degrade, making them penetrable. In fact, in 2001 -- two years before Zeppetella's death -- internal memos from a top executive at the company recommends notifying consumers about the defective product adding: "Lives and our credibility are at stake." Second Chance finally issued a product defect recall in September 2003, three months after Zeppetella's death. It was too little too late.

The California personal injury lawyers of BISNAR | CHASE have pursued and continue to pursue manufacturers of defective autos and other defective products on behalf of our injured clients. We consider it an honor and a duty to fight for the rights of consumers who were injured or killed by a dangerous product that a company put on the market knowing that it was hazardous.

Our Civil Justice System Works

Most businesses in the United States act in good faith to serve their customers. However, there are some who operate recklessly, irresponsibly and unethically and our civil justice system is designed as a forum for dispute resolution. By having a fair and open justice system, corporations who "knew and failed to act" are punished by having to compensate those people who were injured by their defective products. Our civil justice system, in a backhanded way, encourages corporate responsibility. Without a robust civil justice system, manufacturers have little or no incentive to make their products safer or recall those products that they know could cause serious injuries or death.

The nation's schools were not promptly informed about contaminated peanut butter and other recently recalled foods, which resulted in hundreds of food poisoning cases in recent years, a new Government Accountability Office report finds. According to this news article in Consumer Reports, it took up to a week for states to find out what products had been recalled as a result of which the contaminated foods may have been served in federal lunch and breakfast programs in school cafeterias.

According to the GAO report, the U.S. Department of Agriculture's (USDA) Food and Nutrition Service (FNS) failed to make sure that the states and schools got this important recall information in a timely manner. The government provides schools with 15 to 20 percent of the food served in cafeterias, which is eaten by about 30 million children nationwide. The GAO report specifically looked into product recalls involving peanut butter, beef and canned vegetables that were contaminated either by E. coli or salmonella bacteria.

Product Recall News Slow to Reach Schools

Apparently the only time schools were informed about food recalls right away was with a nationwide beef recall after a video showed poor treatment of cows in a California farm where sick cows were also slaughtered. Authorities were slow to get the word out on the peanut butter recall, which sickened 700 people and killed nine across the country. In that case, the manufacturer is being prosecuted for knowingly packaging and distributing peanut butter contaminated with salmonella. The GAO is recommending in its report that federal and state agencies work better and coordinate their efforts to make sure that these product recalls are carried out effectively in the nation's schools.

Food Poisoning Can Cause Serious Personal Injury

It is critical that government agencies get the word out promptly and effectively so that these dangerous and defective products do not affect our children. This is an extremely important issue because it concerns the safety and well-being of our children. It's also significant because we know that bacterial infections are easily transmitted to young children, the elderly and individuals with weakened immune systems. Both E. coli and salmonella infections have the potential to become lethal. The medical, hospitalization and long-term costs of these illnesses can be significant. These food-borne illnesses can also leave children with lifelong and long-term health problems.

If your child has been seriously injured because of contaminated food or food poisoning, please contact an experienced California personal injury lawyer, who will examine and evaluate your case and explain your legal rights and options. Whether the negligence is on the part of the food producers, manufacturers or distributors, it affects consumers. In such cases, the negligent parties should be held accountable. Innocent victims should not be the ones to suffer.

The U.S. Consumer Product Safety Commission is reissuing a defective product recall involving all convertible Simplicity bassinets after two additional infant deaths since the recall was originally issued in August 2008. According to a news report in the San Francisco Examiner, in one of the incidents, a 2-month-old baby suffocated against the adjustable fabric siding of the bassinet. In another incident, a 6-month-old was entrapped in the bassinet's bar opening. There have apparently also been other reports of babies becoming entrapped in this way. In all, four infants have died in accidents related to these defective products.

Product Defects Cause Serious Personal Injury

All of the recalled bassinets were manufactured before May 18, 2008 and include models with the Graco logo as well as the Winnie the Pooh motifs licensed by Disney Consumer Products. The defective bassinets may be returned to the retailers who have voluntarily agreed to provide a refund or store credit after Simplicity became defunct. Consumers, who believe, they own one of these products, are requested to stop using them immediately.

My heart goes out to the family of the two infants who died as a result of this defective product. I offer my deepest condolences to the parents of these children. Please keep them in your prayers.
Over the last year, more than 1 million Simplicity cribs and bassinets have been recalled for similar product defects. Several children – infants and toddlers – have suffered serious personal injury as a result of these defective cribs and bassinets. Most of the defects involving the cribs have to do with the drop side detaching and creating an entrapment hazard for the children. Product liability lawsuits have been piling up against the company.

Importance of Quality Control

Simplicity products are an example of how a total breakdown in quality control can adversely affect an entire company and more importantly, millions of consumers. The tragedies caused by these dangerous and defective products should never be forgotten. This is a lesson not only for product manufacturers, but also for our federal officials, who are still struggling with enforcement of federal safety standards when it comes to imported products. If you or a loved one has been seriously injured or killed as a result of a defective product, specifically these Simplicity products, please consult an experienced California personal injury lawyer, who can give you more information about your legal rights and options.

Many people implicitly trust their safety and their family's safety to their cars and concern themselves only with safe driving. But is your car really safe? Shockingly, many cars have auto defects which can cause a wide range of car accidents, no matter how safely one drives.

Did an SUV roll over? An airbag fail to deploy? A tire come apart? A fuel tank explode? A seat collapse? A roof sustain severe deformation and crush? A seat belt unlatch or otherwise pop open? Unfortunately, these are just some of the incidents that can arise from auto defects. Incidents which can be avoided but befall too many innocent people everyday.

Personal injury lawyers and auto defect lawyers must pay careful attention to these issues when someone suffers a catastrophic injury or loses a friend or family member in a car accident.

Product liability expert and personal injury attorney Brian Chase's new defect book, "Still Unsafe At Any Speed" empowers readers by helping them to evaluate an auto products liability case. The book offers valuable information on the specifics of common vehicle defects and uses real-life accounts to illustrate the traffic implications of defective cars. After all, auto defects don't just concern lawyers and manufacturers. They directly affect all of our lives.

Who should be liable when a vehicle fails to adequately protect its driver and passengers? Did a manufacturer or car dealer knowingly sell you a defective vehicle that could put your family's safety at risk?

Attorney Brian Chase has extensive experience in auto defects cases and has won many lawsuits for his valued clients. He was included on the 2007 list of Top 100 Trial Lawyers by the American Trial Lawyers Association. He was named 2004 Product Liability Trial Lawyer of the Year by the Orange County Trial Lawyers Association and has served as president of the group. He is currently secretary of the Consumers Attorneys of California. A graduate of Pepperdine School of Law, he is a frequent lecturer for various attorney organisations, teaching strategies that enable lawyers to litigate cases involving corporate wrongdoing.
