A number of defective products injure victims every year. Accident victims suffer from a number of different personal injuries. Some suffer from minor injuries while other victims become catastrophically injured.

A products liability case can take no longer or shorter than any other personal injury accident. A defective product claim can settle in as little as 30 to 90 days or as long as 2 to 3 years. There really is no way to gage how long it will take to complete a products liability claim. Every case is unique in and of itself.

Accident victims who have been injured due to a defective product are well advised to seek the council of an experienced California personal injury lawyer. The best attorneys will offer complimentary consultations and a no fee guarantee. This means that if they don't win your case you don't pay.

California car accident victims may also request a free book, "The Seven Fatal Mistakes That Can Wreck Your California Personal Injury Claim." This book is offered to accident victims at no cost. Inside this book you will find valuable information which every California accident victim should have.

The BISNAR | CHASE Personal Injury Lawyers have recovered hundreds of millions of dollars for thousands of accident victims.

Raymond Hill, 55, died after he suffered serious California personal injury when he went into cardiac arrest while operating heavy machinery at the Pharoah's Lost Kingdom, a water park in Redlands, California. Hill apparently died the afternoon of October 12, 2009. He had already been pulled from underneath the Bobcat equipment when firefighters arrived at the amusement park. Hill's co-workers told officials that they went to check on him when he stopped responding to their calls. However, officials also got conflicting reports that Hill was trapped under the equipment and that he was discovered slumped over the steering wheel. Hill was pronounced dead at an area hospital. The California Occupational Safety and Health Administration (Cal-OSHA) is investigating this fatal accident.

My heart goes out to the family, friends and co-workers of Raymond Hill for their tragic and heartbreaking loss. I offer my deepest sympathies to everyone who knew and loved Hill. Please keep them in your prayers.

Fatal Job Injury Kills Worker

Based on this news report, it's not clear why this fatal California job injuryoccurred. There are conflicting reports at this point and investigators are still in the process of interviewing eyewitnesses, co-workers and other who may have either seen this horrific accident or know something about it. There are more questions than answers at this point.

Did Hill suffer a heart attack or cardiac arrest while he was on-the-job working on the equipment? Did the accident occur as a result of his health condition? Or did he accidentally get trapped underneath the Bobcat equipment, which led to cardiac arrest? I trust that is the main issue Cal-OSHA investigators are looking into at this point. If Hill's death was caused by the heavy machinery falling on top of him and crushing him, then certain other questions arise. Was there a product defect or mechanical malfunction that caused the machine to fail? Did Hill have the skill and training to operate the machinery? Were all required safety procedures being followed at the time?

Third Party Claims

In any job-related accident, injured workers (or their families) would be entitled to receive workers compensation benefits. However, California workers compensation benefits are extremely inadequate and would hardly even meet the medical expenses in case of serious injuries or lost earnings when a family tragically loses its primary wage earner. In such cases, it may be in the family's best interest to file a "third-party claim," which is typically filed against someone other than the employer. A third party could be a contractor, sub-contractor or the manufacturer of a defective product. These claims could be worth many times more for the injured worker's family. An experienced California personal injury lawyer will be able to explain the legal rights and options available to accident victims and their families and make sure they receive fair compensation to cover their loss.

Many people implicitly trust their safety and their family's safety to their cars and concern themselves only with safe driving. But is your car really safe? Shockingly, many cars have auto defects which can cause a wide range of car accidents, no matter how safely one drives.

Did an SUV roll over? An airbag fail to deploy? A tire come apart? A fuel tank explode? A seat collapse? A roof sustain severe deformation and crush? A seat belt unlatch or otherwise pop open? Unfortunately, these are just some of the incidents that can arise from auto defects. Incidents which can be avoided but befall too many innocent people everyday.

Personal injury lawyers and auto defect lawyers must pay careful attention to these issues when someone suffers a catastrophic injury or loses a friend or family member in a car accident.

Product liability expert and personal injury attorney Brian Chase's new defect book, "Still Unsafe At Any Speed" empowers readers by helping them to evaluate an auto products liability case. The book offers valuable information on the specifics of common vehicle defects and uses real-life accounts to illustrate the traffic implications of defective cars. After all, auto defects don't just concern lawyers and manufacturers. They directly affect all of our lives.

Who should be liable when a vehicle fails to adequately protect its driver and passengers? Did a manufacturer or car dealer knowingly sell you a defective vehicle that could put your family's safety at risk?

Attorney Brian Chase has extensive experience in auto defects cases and has won many lawsuits for his valued clients. He was included on the 2007 list of Top 100 Trial Lawyers by the American Trial Lawyers Association. He was named 2004 Product Liability Trial Lawyer of the Year by the Orange County Trial Lawyers Association and has served as president of the group. He is currently secretary of the Consumers Attorneys of California. A graduate of Pepperdine School of Law, he is a frequent lecturer for various attorney organisations, teaching strategies that enable lawyers to litigate cases involving corporate wrongdoing.

Propac Distributing Corp., a Los Angeles-area distributor of hooded children's sweatshirts, is recalling about 7,000 of its defective products because they pose a strangulation hazard. According to a CBS News report, the product recall covers the Proclub brand sweatshirts that have a zipper and pullover hood with drawstrings. They were apparently sold at retail stores in Los Angeles and Las Vegas from November to December 2008. The company, which is based in Gardena, says consumers who have these sweatshirts should remove the drawstring from the sweatshirts or return the clothing item for a full refund.

Since the beginning of this year, we've seen a number of these defective clothing recalls involving hooded sweatshirts with drawstrings. Earlier this year, Hill Sportswear recalled 300,000 of its Kid brand pullovers and sweatshirts after a 3-year-old boy in Fresno, California, was strangled to death when the drawstring on his hooded sweatshirt became entangled in a playground set.

In 1999, the U.S. Consumer Product Safety Commission (CPSC) issued guidelines stating that these drawstrings in children's clothing are a hidden hazard and can lead to deaths and serious injuries when they get caught on items such as playground equipment, bus doors or cribs. According to CPSC's statistics, between January 1985 and January 1999, there were reports of 22 deaths and 48 injuries involving entanglement of children's clothing with drawstrings on them.

It's worth noting that the CPSC issued these federal guidelines more than 10 years ago. Still we see these dangerous and defective products being distributed in the United States. A majority of these clothing items seem to be imported. If your child has suffered serious personal injury as a result of these or other defective products, please consult with an experienced products liability attorney. There is no question that these manufacturers must be held responsible for the hazardous products they put on the market. Thousands of American consumers are hurt each year as a result of dangerous and defective products. If you are one of them, I'd like to hear from you.

Kolcraft Enterprises Inc. along with the U.S. Consumer Product Safety Commission (CPSC) has issued a defective product recall of about 1 million play yards, which federal officials say pose a fall hazard and risk of serious personal injury to young children. According to a CPSC safety alert, the play yard's side rail can fail to latch properly and when a child pushes against the rail it can unlatch unexpectedly posing a fall hazard to children. So far, Kolcraft has received 347 reports of sides of these defective play yards collapsing unexpectedly resulting in 21 injuries to young children including bumps, bruises and one concussion.

This defective product recall involves the Kolcraft Travelin' Tot play yards, as well as other similar play yards made for Carter's, Sesame Street, Jeep, Contours, Care Bear and Eric Carle brands. Some of the units also have a bassinet and a changing table. Some models have a mobile, vibrating unit or a parent organizer. The model numbers are printed on a white sticker on one of the feet of the play yards. Consumers who own one of these defective products are asked to stop using them immediately and contact Kolcraft for a free repair kit.

Apparently, some of the models of the play yards included in this product recall were also recalled in September 2007 because of a strangulation hazard posed by a changing table. That product defect resulted in the death of a 10-month-old child.

I hope Kolcraft has not dragged its feet on this particular product recall. Although most injuries reported as a result of these defective play yards have been minor except for the one concussion, fall hazards especially with young children or infants can cause serious personal injury such as brain injury that can have long-term adverse effects.

For injured victims, money from product liability lawsuits is a crutch that helps them move on with their lives. It certainly is not about going after a jackpot or raking in as much as possible. In the case of a brain-injured child, for example, money from a verdict or settlement, helps pay for lifelong care. If a defective product kills a family's sole breadwinner, money from a verdict or settlement helps compensate that family for their loss of future earnings. Product liability lawsuits are also the only way consumers can hold product manufacturers liable for dangerous and defective products that these firms put on the market. If your child has been injured or killed as a result of a defective product, please contact an experienced personal injury lawyer to find out more information about your legal rights and options.
