<p>At least 17 people were injured in an <a href="http://www.bestattorney.com/train_accidents.html" target="_blank">Amtrak train accident</a> in Oakland after one train ran a red light and struck another train that had stopped to unload passengers. According to a news report in the Los Angeles Times, the injury collision occurred the night of October 12, 2011. Most of the injured passengers were in the stopped train. <p>The National Transportation Safety Board (NTSB) has revealed that crew members on board two U.S. Coast Guard boats involved in <a href="http://www.bestattorney.com/watercraft_accidents.html" target="_blank">boating accidents</a> in California and South Carolina may have been using wireless devices for personal conversations and texting just before the crashes. The collision on December 20, 2009 in the San Diego Bay's Parade of Lights killed 8-year-old Anthony Cole DeWeese and seriously injured four others. In that case, the Coast Guard boat with a crew of five collided with a 24-foot pleasure boat. In both cases, NTSB investigators say, Coast Guard crew members were using the communications devices for personal purposes.<span id="more-1143"></span></p>
<p><strong>Distracted Operation Possible in Fatal Boat Crash</strong>    </p>
<p>So far, the NTSB has not determined the cause in either the San Diego or South Carolina crashes. But the federal agency is urging the U.S. Coast Guard to develop a thorough policy on the use of wireless devices by their own members and to issue a safety alert to the maritime industry.</p>
<p>The Coast Guard did issue a policy last month, which prohibits the use of the devices by the boat operator, who is the person at the wheel and the throttles. The policy also bans cell phone use on the part of crew members, unless such use is specifically approved by the boat operator. </p>
<p><strong>Prior Incidences of Distracted Driving</strong></p>
<p>This is not the first catastrophic crash involving cell phone use or texting. There have been many on our roadways and railroads nationwide. According to a news report in The Press Telegram, the injury collision occurred near Pacific Coast Highway and Long Beach Boulevard when a southbound train collided with the officer's patrol car at 16th Street. The officer had to be extricated from the vehicle and was transported to a local hospital. He is expected to survive. In Los Angeles County as a whole, 667 people died and 52,229 were injured as a result of car accidents during the same year. <p>Thousands of fatal and serious injury <a href="http://www.bestattorney.com/auto_accidents.html" target="_blank">car accidents</a> in the United States are caused by distracted drivers. And when these distracted drivers operate large vehicles such as big-rigs or buses, the danger multiplies because there is the potential for a large number of victims. The U.S. Department of Transportation (DOT) is now proposing a federal rule that would specifically ban texting by interstate commercial truck and bus drivers. According to a news report in Consumeraffairs.com, DOT has announced an e-Rulemaking Initiative with Cornell University. <span id="more-910"></span></p>
<p>This basically creates an online public participation environment where people can learn about and discuss proposed federal rules, and provide feedback to the government. Citizens can comment on this proposed texting ban online over the next month. Late last year, federal officials announced their plans for such a federal rule that bans texting by truck drivers. The proposed rule will make permanent an interim ban that was announced in January. </p>
<p><strong>New Federal Rule</strong></p>
<p>This distracted driving rule for truckers and bus drivers has been a long time coming. According to the Federal Motor Carrier Safety Administration (FMCSA), drivers who send and receive text messages take their eyes off the road for about 4.6 seconds. If you are traveling at 55 mph and texting, you are traveling the entire length of a football field with your eyes off the road. Now, if you can imagine an unmanned 80,000-pound tractor-trailer barreling down the roadway, that's what we're talking about here!</p>
<p>Driver distractions are the leading cause of numerous <a href="http://www.bestattorney.com/california-car-accidents.html" target="_blank">California car accidents</a> and near crashes, according to a recent study released by National Highway Traffic Safety Administration (NHTSA) and the Virginia Tech Transportation Institute (VTTI). The study states that 80 percent of crashes and 65 percent of near crashes involve some form of driver distraction. In a majority of these incidents, the distraction occurs within three seconds of the motor vehicle crash. </p>
<p><strong>A Lesson to be Learned</strong></p>
<p>In fact, that is exactly what occurred in the Chatsworth Metrolink <a href="http://www.bestattorney.com/train_accidents.html" target="_blank">train accident</a>, where a train engineer took his train right through a red light because he was texting seconds before the accident. That catastrophic crash, which killed 25 people and injured more than 150 people, prompted Metrolink to put surveillance cameras in its train cabs to monitor the actions of its engineers and conductors on the job. </p>
<p>Distracted driving is a menace. If you must use your cell phone or text, please do not drive. Distracted driving is not very different from driving under the influence. The board recommended installing video cameras in cabs to deter and detect this type of behavior. </p>

<p>Federal investigators also brought up the lack of Positive Train Control (PTC) systems, which is an automatic braking system. Such a braking system would also slow trains that go past a yellow signal and stop them before they go past a red signal. <p>This week will mark the first anniversary of the fatal <a href="http://www.bestattorney.com/train_accidents.html" target="_blank">Los Angeles Metrolink train accident</a> which occurred September 12, 2008, killing 25 and injuring 130. No question about it--it was the worst commuter train accident in Southern California history. A year after the Chatsworth train crash, Metrolink officials are still struggling with changes and safety reforms that are getting more complex and more expensive, the Los Angeles Times reports in a recent article.<span id="more-303"></span></p>
<p>Unfortunately, it took this catastrophic train accident to prod Metrolink to make changes and improvements. First, they learned that the engineer who was operating the train was texting seconds before the crash occurred. He apparently went right though a red light and crashed head-on into a freight train. Secondly, there was also a lot of discussion about the safety technology Metrolink had in place at the time. National Transportation Safety Board (NTSB) officials said during the investigation that they have long been urging Metrolink to install Positive Train Control (PTC) systems that use Global Positioning Satellite (GPS) systems to monitor train locations and speeds. With this system, if engineers ignore signals, the electronic devices automatically put on the brakes. These technologies, federal officials say, may have prevented head-on collisions such as the fatal Chatsworth wreck.</p>
<p><strong>Significant Safety Challenges</strong></p>
<p>A Times investigation shows Metrolink has been facing significant challenges over the last few years. Ridership has been falling. Fare revenues have dropped $1.4 million in the last quarter alone. Operating insurance premiums surged $1 million above estimates because of Metrolink's accident history over the last decade. The average was apparently one potentially catastrophic liability payout every two years. Although, thankfully, no catastrophic crashes have occurred since Chatsworth, smaller Metrolink accidents involving cars and pedestrians have not come down.</p>
<p>The bottom line here is that the Chatsworth tragedy could have been avoided. That is the fact that saddens and angers victims and their families the most. The catastrophic crash could have been avoided by adhering to safety regulations, demanding more aggressive and diligent enforcement of rules and investing in new technologies instead of clinging to antiquated systems. Another requirement Metrolink is looking into is having surveillance cameras in trains to monitor the actions of the driver and conductor. </p>
